Economic Injury Disaster Loans

The U.S. Small Business Administration (SBA) is responsible for providing affordable, timely and accessible financial assistance to small businesses and private, non-profit organizations of all sizes located in a declared disaster area. Financial assistance is available in the form of low-interest, long-term loans for losses that are not fully covered by insurance or other recoveries.

SBA's disaster loans are the primary form of Federal assistance for the repair and rebuilding of non-farm, private sector disaster losses. The disaster loan program is the only form of SBA assistance not limited to small businesses.

The Economic Injury Disaster Loan Program (EIDL) can provide up to $2 million of financial assistance (actual loan amounts are based on amount of economic injury) to small businesses or private, non-profit organizations that suffer substantial economic injury as a result of the declared disaster, regardless of whether the applicant sustained physical damage.

An EIDL can help you meet necessary financial obligations that your business or private, non-profit organization could have met had the disaster not occurred. It provides relief from economic injury caused directly by the disaster and permits you to maintain a reasonable working capital position during the period affected by the disaster. EIDLs do not replace lost sales or revenue.

General Program Requirements
To be eligible for EIDL assistance, small businesses or private non-profit organizations must have sustained economic injury and be located in a disaster declared county or contiguous county.

Loan Terms
Disaster victims must repay SBA disaster loans. SBA can only approve loans to applicants with a reasonable ability to repay the loan and other obligations from earnings. The terms of each loan are established in accordance with each borrower's ability to repay. The law gives SBA several powerful tools to make EIDLs affordable: low fixed interest rates and long-terms (up to 30 years). As required by law, eligibility is based on SBA's determination of whether each applicant does or does not have the ability to borrow or use their own resources to overcome the disaster.
The SBA can provide up to $2 million in disaster assistance to a business. The $2 million loan cap includes both physical disaster loans and EIDLs. There are no upfront fees or early payment penalties charged by SBA.

Disaster Legal Services

Disaster Legal Services (DLS) provides legal assistance to low-income individuals who, prior to or as a result of a Presidentially declared major disaster, are unable to secure legal services adequate to meet their disaster-related needs. When the President declares a disaster, the Federal Emergency Management Agency (FEMA), through an agreement with the Young Lawyers Division of the American Bar Association, provides free legal help for survivors of that disaster.

Legal advice is limited to cases that will not produce a fee (cases where attorneys are paid part of the settlement, which is awarded by the court). Cases that may generate a fee are turned over to the local lawyer referral service. The assistance that local lawyers provide typically includes:
•Help with insurance claims for doctor and hospital bills, loss of property, loss of life, etc.
•Preparing new wills, powers of attorney, and other legal documents lost in the disaster
•Help with home repair contracts and contractors
•Advice on problems with landlords

In order to qualify for this program, you must reside in an area that has been declared a major disaster area by the President.

An unemployed disabled man - a friend- is losing his home because he had to choose between medication to control his seizures, making earthquake repairs that will keep his trailer from falling apart, and paying his mortgage.  He is trying to navigate the public assistance system and has applied fopr disability but it takes time... he is out of money and has no family. No income. If you can spare a dollar or two it could add up to real help. I have sent him as much as I can afford and have sold some gold jewelry as well to come up with some cash. can you help with  jsut a small donation? Please?

Where do I even begin? Everything is wrong.

I'm laying down on a tiny couch in the one room apartment I have to move out to move out of as soon as I can find a way. There was a big plumbing problem in the building, and my place flooded. I had to clan a lot of it up myself, and got sick. Now, with no money, I'm trying to figure out how to move me and my cats to a safer, better enviornment.

I'm exhausted, but I can't sleep. On top of the situation at hand I have a horrible toothache. Finally I have gotten some state benifits, but they will only cover dental stuff if it's an emergency- so I've had to wait till now to even be able to get an appointment. Someone will see me Monday... I'm so relieved...but in a lot of pain. I don't know how to get throug till then...but I will. 

Somehow, regardless, I have to pack, and figure something out. I have no car. I only moved to the state I'm in a little while ago, and have few resources here. I need somehow to come up with the resources to travel with my pets and my stuff, and go back to New Orleans whre my heart is.

Hello,

Out of desperation for my situation I typed "I need $20,000" into Google and it showed me this page. I have no idea why I am doing this except I don't know what else to do...

I have a wife, a daughter and another baby due in October. Out of a desire to have a family where my wife can stay home and raise our children and to create a better situation for those around us, I took a well planned investment and began an importation business. A delay in shipping caused our product to arrive on the market 3 weeks after a lesser, cheaper alternative did. All deals fell through.

To cut a long story short I am now in desperation for $20,000 to relieve our financial pressure and take the crediters off our back. We are at high risk of losing our home, and I do not know how my wife and I would handle it if another thing went wrong. The past 18 months have been turmoil from car trouble, unforeseen medical expenses, employment...

I don't know what to do. As I sit here and right I have just found out the bank has began legal preceedings to take our home.

I need help from somewhere but I don't know where. I prayed a prayer out loud and said to God that I don't deserve his help but I don't know what to do. Next thing I know I am sitting here typing this. My only prayer is that this is some sort of God send. We are good people who have just had a very long string of bad luck.

My wife and I entered into a lease purchase agreement for a house on September 30, 2007. At the time we enterd into this agreement, we were required to maintain insurance on the property for dwelling and contents as a term of the agreement. The owners of the property insisted, prior to the lease signing, that we use their own agent for insurance, as he was "the only agent they trusted" and because "we have been using him for years" We agreed to this term and the owners of the home stated that they would contact the agent and "set the insurance up" for us. At the signing of our lease purchase agreement, we were provided an insurance binder from the  Insurance Agency listing Travelers Insurance Company as the insuring company and myself and my wife as the insured for property and content with the landlords listed as the mortgage holder. We provided total payment of $1229.00 for the first years insurance and enterd into an agreement to provide payment of an additional $102.42 per month in addition to our payments to escrow the next years insurance payments. On Feb. 28th, 2008 we suffered a accidental kitchen fire in the home. The fire in the home was contained to the kitchen and dining room, however, all of our contents suffered major smoke and water damage and is a loss. On Feb. 29th an adjuster from the insurance company arrived at our home and stated that he was "only here for the structure" He futher stated that he "showed no coverage for contents" I called the Insurance Agency and was told we  "have no insurance on the home" When I informed the agent that I had, in my hand, a copy of the binder signed by him saying we did, the agent changed his story to "the underwriter had the policy changed a few weeks ago" He stated that we did not "have an interest in the house" and that the underwriter "required that "the owner be insured" My family of six including children ages 13, 11, 10, and 8 today, have nothing. We are homeless as a result of this fraud.  The loss of our home and it's contents has left our family without anything and Friday (when our money for hotel rooms runs out) without even a roof over our heads or food for my family. My wife and I have god jobs but we have spent all of our savings to provide the basics for our children. I can not bear to watch them cry at night anymore. Anything would help. All we want is to feed and house our children while the attorney and insurance company fight this out and we are stuck without anything.

NEED A HAND UP NOT A HAND OUT NEW JOB BUT NEED HELP CATCHING UP

Hi, like many good people here I am at a loss as to how to deal with my current situation. I was forced to relocate after Hurricane Katrina. The company I worked for in New Orleans held on until April of this year but could not recover financially so I lost the main support for my three children. I was finally able to find a new job but after 5 months of searching I maxed out everything I had to keep everything covered. Now of course I have my new job but next week I face rent and several other bills coming due that I cannot pay because instead of seeking this help sooner I took out a couple of payday loans not realizing they would eat me alive. I have always helped others and now find myself in need of help. I thank you for your consideration I realize there are many many people in my same situation and pray we all find the way out. I am a hardworking person, I have worked full time since I was 17, I have actually tried several different routes as far as a loan goes however I can't get anyone to lend to me at this point because of the last few months ( no matter what interest rate I was willing to pay). Thanks again for looking, I appreciate and help or guidance you can offer.
